TERMS OF USE 

Section 1 Easybids as an Online Marketplace

1.1           By using this online marketplace, you are deemed to have accepted and to be bound by our rules, regulations, terms and conditions. You agree to solve any dispute between you and Easybids through binding individual arbitration instead of court proceedings.

1.2     Easybids facilitates online transactions between sellers & buyers. We do not own any items listed. All items listed or sold on our platform are owned by the sellers. The sale contract is made between buyer and seller.

1.3           Easybids employs strict screening mechanisms in selecting the objects to be sold. It is up to us and our experts to decide which objects are selected for sale.

1.4        Easybids uses and/or recommends third-party providers, such as for payment or shipping, in order to ensure seamless sale and after-sale process. Use of third-party services may be subject to such provider’s terms and conditions.

1.5          Easybids is committed to handling your personal data according to local laws and regulations following all laws for personal data on this platform and its applications. Please visit our Privacy Policy Page for additional information.

1.6           When Easybids charges the customer a fee on top of the purchase price, or a shipping fee, this fee will be clearly stated with the item. These fees are subject to change and can vary per category or item, Easybids declares to be transparent & fees will be stated with the item for sale. 

1.7  By utilizing the Easybids platform, you unequivocally consent to abide by these Terms of Use and release Easybids from any responsibility, detriment, or harm arising directly or indirectly from our services or the products offered on this site, including issues related to any shortcomings on the part of a Seller. Easybids does not provide any warranties, whether explicit or implied, concerning the condition, suitability for a specific purpose, or non-infringement of intellectual or other rights.

1.8     Not confined to alternative courses of action, Easybids maintains the right to promptly caution, suspend, or terminate your access to the Site and refuse to provide services to you under the following circumstances: (1) in case of a breach of this User Agreement or the referenced documents; (2) if Easybids can not verify or authenticate    any information provided by you; or (3) if Easybids has grounds to believe that your actions may lead to legal liability for yourself, other Easybids users, or Easybids.ph. Easybids retains the discretion to terminate this Agreement or your access to the Site at any time in response to conduct deemed unacceptable by Easybids, as determined solely by its discretion. 

1.9           Any question or dispute in relation to the Terms of Use of this platform must first be communicated to the administrators of this site for possible resolution or remedy, before any resort to any judicial remedy. Venue of any judicial remedy shall be at the courts in Tagbilaran City, Bohol, Philippines, to the exclusion of any other venue, under the understanding that the governing law is the law of the Philippines. It is agreed that any question or dispute, not reported to us within the 6-month period from occurrence of the object of the dispute, shall be deemed to have lapsed or prescribed from availing any remedy.

1.10   Easybids holds the right to modify, amend, add, or revise its Terms of Use at any given time. These alterations will take effect immediately upon being posted, without the necessity of prior notice. Your ongoing use of the platform indicates your acceptance of these changes.

1.11   Participants on this platform are anticipated to be of legal age and should not encounter any impediments under Philippine law that would hinder their ability to enter into a contract.

1.12   If required, we reserve the right to cancel a sale under various circumstances, including but not limited to: suspected counterfeit or stolen items. Allocation of the item to an incorrect bidder or buyer due to technical issues, outages, or irregularities. Unforeseen situations preventing the fulfillment of the sales contract, also known as force majeure.

You explicitly acknowledge and agree that we possess this third-party right under the sales contract and can enforce it.

Section 2 How Easybids works

1.1     Easybids has put in place mechanisms to avoid meddling, interference, fraud and similar scams in the bidding of items.

1.2       It is understood that a seller can set a minimum bid price for his/her item.                         If the minimum bid price is not met at the end of the bidding time, 

the item is deemed not sold.

1.3           Items are placed on the marketplace for bidding, direct buying or both the option to bid or buy directly. The highest bidder at the end of the bidding buys the object if the reserve price is met. Every successful bid is binding. The buyer is not allowed to retract from his/her bid.

1.4      Upon a successful bid or direct purchase, a contract of sale is concluded between the seller and the buyer.  It is therefore the obligation of the buyer to pay the purchase price and all related costs (including but not limited to any import taxes or tariffs that arise from shipping to another country outside the Philippines) and the obligation of the seller to deliver the item to the buyer.

1.5           Easybids is not directly involved in the contract of sale. In the event of dispute or failure of any party to comply with its obligation, Easybids will exert efforts to provide a solution and in exceptional cases cancel the contract of sale.

1.6           Attempts or maneuvers to increase or influence the bid price, such as but not limited to bidding on your own object or asking your friends or relatives to bid on your own object, is strictly forbidden.

1.7           Easybids reserves the right to remove a bid or item or cancel the sale on account of suspicious activity as a protective measure.

1.8           In the event of any error relating to bidding arises during or after the bidding, it is agreed that our decision as regards such error is final and binding.

Section 3 Seller’s Terms

3.1           To offer items in our marketplace, you must first register as a private seller or an institutional seller. Your registration will undergo an assessment before you are allowed to become a verified seller. We look for trusted sellers with a proven track record, good standing and reputation.

3.2    After registration, you may now submit an item for sale, providing accurate description, photos/videos, and pertinent documentation thereof. We will then review your submission if the same meets our criteria and if the same is suitable for sale in our marketplace. Our decision as regards acceptance and/or rejection of an item is final and binding. We may also translate and/or propose changes to the item description, when warranted, but it is still your responsibility to provide correct and accurate item description.

3.3           Easybids does not guarantee that the item will be sold. It is understood that we are allowed perpetually and irrevocably to promote, advertise, and market the items in any format and through any channel, royalty-free. It is understood that Easybids shall be held free and harmless from any liability resulting from infringement of copyright or other proprietary rights of the submitted photos, videos or documentation.

3.4           You, as seller, warrant and guarantee that in selling an item, you are compliant with the law, you have the right to sell the item, your item is authentic, and you shall defend that buyer from claim whatsoever over the item.

3.5          Items up for bidding cannot be withdrawn for the duration of the bid, in the exceptional case that an item is not available anymore Easybids reserves the right to withdraw the item from the platform.

3.6           You, as a seller, are allowed to promote your item through social media using the link in our platform.

3.7           Attempts or maneuvers to increase or influence the bid price is strictly forbidden.

3.8           Taxes and fees in relation to the sale of your items shall be to your account as seller.

3.9       Easybids reserves the right to remove any items, violative of our terms and conditions. Our decision on this matter is final and binding.

3.10  Seller’s fees apply when an item is sold through the platform, these fees will be automatically deducted from the purchase price when the payment is transferred to the seller.

3.11  Shipping will be the responsibility of the seller and should be done within 7 days of Easybids receiving payment. It is mandatory and the responsibility of the seller to ship all items with package insurance.

3.12   Easybids Escrow service protects buyers and sellers from fraudulent transactions. Item payments are held by Easybids until they are confirmed as delivered.

3.13       Easybids reserves the right to impose sanctions and penalties for your failure, as seller, to fulfill your obligation among others to deliver the item and /or to fulfill your warranties as regards the items to be sold, without prejudice to reporting you for fraud before pertinent government agencies.

3.14       Easybids verifies and approves all items sold on the platform to ensure the integrity of the sellers in our marketplace.

Section 4 Buyer’s Terms

1.1           Easybids employs strict mechanisms in selecting the items to be sold and in verifying their corresponding sellers.

1.2           All bids are valid and binding. Thus, you cannot retract and/or revoke bids. If you are the highest bidder, there is now a concluded contract of sale.

1.3           Some items have a minimum bid price. If the minimum bid price is not met at the end of the bidding time, the item is deemed not sold.

1.4           Each item is sold on “as is where is” basis, although the color on the screen may look different vis-a-via on actual inspection. It is therefore your responsibility, as buyer, to carefully review the item as described.

1.5        The buyer is responsible for paying the item and all related costs such as but not limited to shipping fees within 3 days of placing a winning bid.

1.6           Payments: We accept a wide variety of payment methods and secure your payment in our Escrow system until your item is safely delivered.

1.7           All items are verified by Easybids and shipping is done only with insurance, giving customers the highest security.

1.8           Upon receipt of the bid item, you need to examine the items. If you have concerns on the item received vis-à-vis the item bid, you may contact us within three (3) days from receipt. Otherwise, our payment provider will release the payment to the seller. After three (3) days, any concerns/complaints as regards the item shall be deemed to have lapsed and prescribed.

1.9           If you, as a buyer, have concerns on the items received, you have the option to cancel the sale and return the item within three (3) days from receipt. In most cases however, shipping cost shall be chargeable to you. It is understood that only cancellation for legitimate reasons will be allowed.

1.10       Easybids reserves the right to impose sanctions and penalties for your failure, as buyer, to fulfill your obligation among others to pay for the item, without prejudice to reporting you for fraud before pertinent government agencies.

Section 5 Miscellaneous Provisions

1.1           Users of this platform are expected to observe proper decorum.

1.2           Easybids reserves the right to engage in a merger, acquisition or sale of all or a portion of its rights over this platform, without need of notice or consent from any stakeholder.

1.3            Easybids can not be held liable for any issues that arise beyond our control or because of actions we take for the safety or reliability of the platform. This encompasses, but is not restricted to, any harm resulting from: 

• Violations of our Terms and illegal utilization of our marketplace.
• The utilization of our services and online marketplace, encompassing, but not limited to, your engagement with our services.
• Providing false or inaccurate account information, withholding any requested data or information.
• Your participation in bidding, purchasing, or selling items on our online marketplace.
• Shipping or returning of items.
• Potential discrepancies in the valuation or accuracy of the sale price of items.
• User-generated content subject to removal or modification.
• Events related to the execution, completion, cancellation, or termination of a sales contract, including the enforcement of our contractual rights.
• The state or working order of items purchased on Easybids.
• Measures taken to find a solution for claims or maintain the safety and fairness of our marketplace.
• Mistakes in any of our published content, such as our Terms and policies.
• User-generated content or communications that are inaccurate or unlawful.
• The utilization of services provided by third-party service providers.
• Instances the platform has technical issues, or other challenges limiting your access to our marketplace.
